TERMS AND CONDITIONS
1. Definitions
“We”, “us”, “our”, or “askTony” means Ask Tony Limited, whose registered address is: 17 Studley Road, Luton LU3 1BB. The company number is: 3808674
“‘The Client” or “you” means the person, firm or company or their representative to whom we provide the Quiz.
“Quiz” means a quiz event or any associated quiz services provided by askTony, and shall include the provision of quiz questions, the running, attending or setting up of a quiz and the general giving of advice or carrying out of a chargeable service for you.
2. General
A contract for the provision of a Quiz will come when you give email confirmation to us of your acceptance of these conditions.
This agreement forms a binding contract between askTony and you. The contract may only be varied with the written agreement of both parties. Your rights under this contract may not be resold, assigned or transferred without the written consent of askTony.
3. Payment
Payment terms can be found on your invoice. You must pay in full within 30 days of the issue date of each invoice. The person who emails confirmation of acceptance of these terms and conditions is responsible for ensuring that askTony is paid according to the terms and conditions.
askTony is not currently VAT-registered.
4. Booking and Cancellation
All bookings will be regarded as provisional until email confirmation accepting these terms and conditions is received by us. The following cancellation fees apply when confirmed bookings are cancelled by you before payment has been received:
Cancellation on the date of the Quiz: Full price of the Quiz
Cancellation between 1 and 10 days before the Quiz: Half of the full price of the quiz
Cancellation between 11 and 30 days prior to the Quiz: £50
Cancellation 31 days or more before the Quiz: No charge
For cancellations where payment has already occurred askTony will not provide a refund but agrees to provide a quiz to the same specification for you within 12 months subject to agreement of a convenient date between askTony and you.
askTony reserves the right to cancel a quiz upto 10 days before an event at no cost provided no monies have been paid by you at the date of cancellation.
5. askTony's responsibilities
askTony will maintain public liability insurance of £2 million for accidents caused by our negligence or the failure of our equipment.
6. Your responsibilities
Unless agreed in writing otherwise, the client is required to provide electricity at the venue. This must consist of a minimum of one 13 amp power socket within a 5m distance of the quizmaster.
The client is required to provide suitable furniture and sufficient space (minimum 3 metres by 2 metres) for the askTony team and their equipment.
7. Force Majeure
askTony will make every effort to ensure that it meets its obligations to you, but it is not liable if it fails to do so due to circumstances beyond its control, including, but not limited to: fire, flood, illness, war, terrorism, strikes, power failure or accidents.
8. Limitation of Liability
To the extent permitted by law and except as expressly provided to the contrary in this agreement, all warranties whether express, implied, statutory or otherwise, relating in any way to the subject matter of this agreement or to this agreement generally, are excluded.
Where legislation implies in this agreement any condition or warranty and that legislation avoids or prohibits provisions in a contract excluding or modifying the application of or the exercise of or liability under such term, such term shall be deemed to be included in this agreement. However, the liability of askTony for any breach of such term shall be limited to the supplying of the Quiz again; or the payment of the cost of having the Quiz supplied again.
To the extent permitted by law and except as expressly provided to the contrary in this agreement, askTony shall not be under any liability (contractual, tortious or otherwise) to you in respect of any loss or damage (including, without limitation, consequential loss or damage) howsoever caused, which may be suffered or incurred or which may arise directly or indirectly in respect to the supply of goods or services pursuant to this agreement or the act, failure or omission of askTony.
10. Law & Jurisdiction
These conditions are governed by the law of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
